The Environment is What we Have in Common

The surroundings or to be more specific the environment, which is derived from the French word “environ”, is something you are very familiar with, which is everything that makes up our surroundings and in turn influences our ability to live on the earth-the air we breathe, the water that covers most of the earth's surface, the plants and animals around us, and a whole lot more. In recent years, scientists have been carefully analyzing the approaches that humans affect the environment. The environment is the total of perquisites that surrounds us at a given factor of time and space which is comprised of the interacting systems of physical, biological, and cultural factors that are interlinked each for my part and collectively. The period “environment” is often used interchangeably with an ecological term ‘ecosystem’, which can also be described as a region of interacting organisms together with their bodily surroundings. It is also to be referred to all-natural environments that have been at as soon as or indirectly influenced by the useful resource of human beings at some point of time, and are a product of the interplay between nature and humans.


Speaking vividly as to what is Environmental law, it can be said that it is the collection of laws, regulations, agreements, and frequent laws that governs how people engage with their environment. The sole purpose of environmental law is to create a shield for the environment and giving out hints for how human beings can use natural resources. Enacting environmental law is not the only reason to protect the surroundings but to additionally figure out who can use such natural resources and on what terms. Laws may alter when it comes to the use of natural resources, forest protection, mineral harvesting, and also safeguarding animal and fish populations.


Now when I say about energy laws, it is the laws that are solely concerned with creating, imposing, and tough crook suggestions that alter the use of energy, as in the production and harvesting of energy. Some pointers alter the taxation of energy use. Companies that are indulged with energy laws and public alike ought to navigate energy laws as they relate to the sale, use, and conservation with energy resources. Many human beings don’t apprehend how remarkably energy laws have an impact on their day to day life. Each time I put gas in my vehicle, I am paying energy taxes. Also whenever I sell a vehicle or renew my license plate, I am directly or indirectly paying taxes to the state I live in. When I am using electricity power at home, I am using it from an electrical energy plant that is compelled with policies to conduct business. Energy laws prevail at federal, state, and even on local terms which also has an impact on international relations.


1. The 42nd Amendment to the Constitution of India added Article 48A and 51A(g) that come under the Directive Principle of State Policy and the Fundamental Duties respectively. The Supreme Court of India in “Sachidanand Pandey v. State of West Bengal AIR 1987 SC 1109” stated that whenever a case related to Environment is brought to the court, the court is bound to bear in mind about the above articles.

2. The Supreme Court of India in “Damodar Rao v. S.O. Municipal Corporation AIR 1987 AP 171” it was directly amounting to a violation of Article 21 of the Indian Constitution as the environmental pollution and spoliation was slowly poisoning and polluting the atmosphere

Thus when Environmental law comes with Energy law, it tries to lower the gap between legal proposition proposed to achieve environmental and energy-related objectives and also technical considerations which can be applied to the same problems arising out of the environment. These type of laws generally comes up with issues from energy regulations, an innovation of technology to pollution control, governance as per the environment, and enforcement of laws to safeguard the environment as a whole.
